Questions on Onda V972 Tablet PC Android A31 Quad Core RAM 2GB WIFI HD 2160P Dual Camera White

I am having trouble with my tablet - Onda V972 (android version 4.2.2) (firmware version (V3.2.1_V1) (kernel version 3.3.0 lgm@SzExdroid5 #1)
It suffers from great battery drain - does not even last two hours.
The tablet also resets to factory defaults every time it restarts. I lose all my apps and data!
Finally, I am aware that the tablet has received an firmware update, unfortunately, it doesn't update Over The Air and the link on this site for a local download does not work either.
I require a solution to the issues I am facing so that I can continue to use the tablet.

- Just received my Onda v972 tablet and upon turning it on everything is fine until I try to access the apps with the app button at the top. The tablet then freezes up and will not respond to any touches. It will then sit for about 3 minutes and then try and restart which it does but then locks up when apps button at top right is touched again. It sounds as if there is a firmware problem. It came with version 4.1.1 and I have used the update button in settings but it will not actually retrieve or update. Does anyone have any clues as to what can be done? This unit was purchased 1/26/2014 via ebay and due to my being on vacation I just opened the box 2 and 1/2 months after initial delivery so that I cannot receive any refund and no recourse other than attempts on my part to repair. Some help will be appreciated.

1) if I order today will the tablet come with the latest firmware which solves all bugs
2) If so What is the latest firmware version that will be installed on the Tablet?
